§ 46-29. Authorization for the charging of a fee for accident reports.

  • (a)

    The driver of a vehicle involved in an accident shall file with the police department for the Town of Marion a report of the accident.

    (b)

    These reports shall be for the confidential use of the police department for the Town of Marion and subject to the provisions of Title 46.2 Subtitle II Chapter 3 Article 11 of the Virginia Code Annotated (1950, as amended).

    (c)

    The police department for the Town of Marion shall make the reports, including the report of the law enforcement officer, and including any photographs taken by law enforcement officers, available for inspection by any person involved or injured in the accident or his or her attorney or any authorized representative of any insurance carrier reasonably anticipating exposure to civil liability as a consequence of the accident.

    (d)

    The fee to be charged for copies of the reports and photographs shall be as determined by the town council for the Town of Marion. The fee shall be displayed in the minutes of the town council.
