§ 26-3. Plots.

  • (a)

    Price and sale. Sale price of plots in the cemetery shall be fixed by the council and upon the sale of any plot by the manager, such amount shall be paid to the treasurer and disbursed by him pursuant to the terms of the perpetual upkeep agreement with the Marion office, First Union Bank, trustee.

    (b)

    Fee simple title to remain in town; effect of sale. The fee simple title to cemetery plots when sold shall remain in the town; the purchaser and his assigns shall acquire burial rights in such plots with the right to erect and maintain a mausoleum, tombstones and markers thereon. No wall around such plot or within such plot or any other structure shall be erected on any plot without the prior approval of the council.

    (c)

    Maintenance; opening graves. Maintenance, mowing grass, trimming shrubbery and opening and closing graves, with reseeding thereon, of all plots and the entire cemetery shall be under the supervision of the town manager.
